Application "TGV INOUI Experience"

The "TGV INOUI (VisionOS)" application (the "Application") is offered by SNCF Voyageurs, a société anonyme (public limited company) with share capital of €157,789,960, whose registered office is located at 1 rue Camille Moke, 93200 SAINT-DENIS, registered with the Bobigny Trade and Companies Register under number 519 037 584.

It is hosted by SNCF Voyageurs SA – General Management, Marketing Department, Digital Transformation Department.

These Terms and Conditions of Use (the "Terms") define the conditions of access to and use of the Application "TGV INOUI (VisionOS)", accessible at https://cguen.s3.eu-west-3.amazonaws.com/index.html.

They take effect on 25 August 2025. This edition cancels and replaces previous versions.

Users of the Application are invited to read the Terms carefully and accept them before first use of the Application. SNCF Voyageurs reserves the right to amend the Terms at any time. Users are therefore invited to read the Terms at each use of the Application.

The Terms of Use may be translated; only the French version is legally binding.

1. DEFINITIONS

For the purposes of these Terms, words or expressions beginning with a capital letter, in the singular or the plural, have the following meanings:

Application: the TGV INOUI immersive mobile application of SNCF Voyageurs for Apple Vision devices running VisionOS, accessible to Users.

Cookie(s): computer files stored on the hard drive of the User's computer or any mobile device such as a smartphone or tablet.

Publisher: SNCF Voyageurs.

Information(s): all information and publications accessible on the Application.

User(s): any person using an Apple Vision device (e.g., Apple Vision Pro) running VisionOS to access the Application, on an individual and non-commercial basis.

2. PURPOSE OF THE APPLICATION

The Application offers a free immersive experience enabling Users to discover the new TGV INOUI virtually in a 3D environment, for information and brand-discovery purposes. It notably presents a simulation of the on-board TGV INOUI Wi-Fi portal (information, brand pages) without transactional features.

It enables the User to navigate between different scenes and information pages, display/close information panels, and explore the interior of the train interactively.

3. USE OF THE APPLICATION

Each User may access the Application by downloading it free of charge from the App Store on a compatible Apple Vision device (VisionOS) and launching it from the VisionOS interface.

The Application is accessible on an Apple Vision device (e.g., Apple Vision Pro) running a supported version of VisionOS.

4. OBLIGATIONS AND LIABILITY

4.1. User's obligations and liability

The User undertakes to comply with these Terms. The User also undertakes to comply with the practices and rules, including security rules, laid down by the SNCF Group (charters, reference frameworks, etc.).

The User of the Application acknowledges that they have the skills and resources required to access and use the Application, in particular a compatible Apple Vision device and an up-to-date version of VisionOS.

The User is liable for any use of the Application that is not compliant with the Terms.

The User shall refrain from any action liable to hinder or disrupt access to, or the proper functioning of, the Application.

The User declares that they are fully aware of the characteristics and constraints of the Internet, and in particular that the transmission of data and information over the Internet is only of relative technical reliability; such data circulates over heterogeneous networks with differing characteristics and technical capacities that may disrupt access or make it impossible at certain times.

The User is liable to SNCF Voyageurs and/or third parties for any material and/or non-material damage of any kind caused by the User as a result of use of the Application.

The User accepts that SNCF Voyageurs may:

SNCF Voyageurs reserves the right to suspend temporarily or permanently terminate access to the Application for any User who does not comply with the obligations set out in these Terms.

The User acknowledges that enabling the VisionOS "Developer Mode" is undertaken on the User's sole initiative and responsibility; SNCF Voyageurs cannot be held liable for any effects or malfunctions resulting from such activation.

The Application operates with embedded content and does not require an Internet connection to view integrated content.

4.2. SNCF Voyageurs' obligations and liability

SNCF Voyageurs endeavours to make the Application accessible 24 hours a day, 7 days a week, except during maintenance periods or in the event of force majeure.

SNCF Voyageurs undertakes to take all necessary technical and organisational measures to protect information circulating on the Application. However, SNCF Voyageurs does not warrant that the Application is free from anomalies, errors or bugs. Each User is responsible for taking all appropriate measures to protect their own data and/or software against contamination by any viruses circulating on the Internet. SNCF Voyageurs shall not, in any circumstances, be liable for incidental, material and/or non-material damage that may result from access to or use of the Application, including inaccessibility, loss of data (excluding data processed under Article 6 of these Terms), deterioration, destruction or viruses that may affect the User's equipment, and/or the presence of viruses on the Application.

The Application is strictly informative and immersive; it offers no transactional services (booking, purchase, authentication) and no account functionality.

5. INTELLECTUAL PROPERTY

SNCF Voyageurs and/or any company of the SNCF Group hold all intellectual property rights (copyright, neighbouring rights, sui generis database producer rights, trademark rights, domain names, etc.) relating to the structure and content of the Application, or have duly acquired the rights enabling exploitation of the structure and content of the Application, without limitation.

Access to, and private, non-commercial use of, the Application by the User confers no rights upon the User over the intellectual property rights relating to the structure and content of the Application, which remain the exclusive property of SNCF Voyageurs or any company of the SNCF Group.

Consequently, the User shall refrain from infringing the intellectual property rights of SNCF Voyageurs, any company of the SNCF Group and/or any third party.

In particular, the User is prohibited from copying, reproducing, downloading, displaying, modifying and/or exploiting, adapting, or transferring in any manner and for any purpose whatsoever, by any means and on any medium, all or part of the structure and content of the Application, including but not limited to the domain name, trademarks, logos and domain names, without the prior express written authorisation of SNCF Voyageurs. This prohibition includes, without limitation, practices such as scraping or the use of robots for the extraction or reproduction of any element of the Application.

SNCF Voyageurs, or any company of the SNCF Group, reserves the right to bring legal proceedings against any person who fails to comply with the above prohibitions. Any infringement of the intellectual property rights of SNCF Voyageurs or any company of the Group, or any unauthorised exploitation, reproduction or download, may give rise to any appropriate action, including an action for infringement which may engage the civil and/or criminal liability of the offender.

6. PERSONAL DATA PROTECTION AND COOKIES

No personal data is collected by SNCF Voyageurs in connection with the Application.

The Application does not use cookies or trackers.

7. SEVERABILITY

If all or part of one or more provisions of the Terms is held invalid pursuant to a statutory or regulatory provision or a final court decision, such invalidity shall not render the other provisions, or the remainder of the provision not affected by invalidity, null and void.

8. GOVERNING LAW AND JURISDICTION

These Terms are governed by French law.

In the event of any dispute relating to the interpretation, validity or performance of the Terms, the User and SNCF Voyageurs agree to use their best efforts to settle the dispute amicably.

Failing amicable settlement, and to the extent permitted by applicable law, the dispute shall be submitted to the courts having jurisdiction.
